Certifiers, councils and building disputes in Rouse Hill NSW
Rouse Hill is divided between The Hills Shire Council and Blacktown City Council, so the first thing to know is which one your lot sits in. After approval, a principal certifier takes charge of the critical stage inspections and issues the occupation certificate at the end. If a defect is not fixed, NSW has a defined path: written notice to the builder, a complaint to NSW Fair Trading, and then the Consumer and Commercial Division of NCAT.
Which council
Your development consent or complying development certificate names the consent authority. The boundary between The Hills Shire and Blacktown runs through the suburb, so neighbouring streets can sit with different councils.
The principal certifier
The principal certifier inspects the build at critical stages set by regulation and issues the occupation certificate. Their role is compliance, not managing your contract or your builder's workmanship.
Statutory warranties
The Home Building Act gives statutory warranties of six years for major defects and two years for other defects, running from completion. A dated inspection report is the strongest record of when a defect was present.
NSW Fair Trading
If the builder will not respond, lodge a complaint with NSW Fair Trading. It can arrange a building inspection and may direct the builder to rectify.
NCAT
Where a dispute does not settle, NCAT hears it. Evidence there comes as an expert witness report written to NCAT Procedural Direction 3, which is a different document from a stage or handover report.
